After the Law 215/2000 was enacted it occurred the problem of incompatibility between the quality of member in the local and county councils and that of president or member in the boards of administration of local authorities (regii). The Emergency Ordinance 5/2002 did not provide too many clarifications. The article tries to explain some of the reasons why the problem is so controversial, as main reason being the terminology used.
