TRAFICUL DE INFLUENTA SI DAREA DE MITA - INFRACTIUNI CU O FRECVENTA RIDICATA IN ADMINISTRATIA PUBLICA
Bribing and traffic of influence are studied together because of the underlying social relations – those concerning the work-related activities whose correct development are incompatible with any corruption that can manifest itself in any activities of the civil servant. Bribing is characterized by the fact that it represents an active process which aims at corrupting – by a private person- of the public servant in his/her activities. Traffic of influence consists of receiving or claiming money or other goods, or accepting, directly or indirectly, gifts, promises, for personal use or for someone else’s. This is done by the person who influences (or allows other people believe that he/she can influence) a civil servant in order to determine the civil servant to do (or not do) something that belongs to its job description.
